Fined RM1,200 for drunk driving

KUCHING: A Magistrates' Court here yesterday fined a man RM1,200 in default two months' jail after he pleaded guilty to driving under the influence of alcohol.

The 32-year-old accused surnamed Chan was convicted under Section 45A(1) of the Road Transport Act 1957, which carries a maximum fine of RM6,000 or a jail term up to 12 months.

He committed the offence around 12.20am on June 15.

Another man who was charged with rioting in public place was fined RM800 in default two weeks in jail.

Bong Chee Kion, 24, pleaded guilty to being involved in a brawl at the ground floor of a shopping mall in Jalan Song about 3am on April 19.

He was arrested on June 27 following a police report lodged against him.

Rioting, which comes under Section 147 of the Penal Code carries a penalty of up to two years, or with fine, or both on conviction.

Kampung Tabuan Melayu man pleads not guilty to robbery

KUCHING: Norsalihmin Rohmin, 23, from Kampung Tabuan Melayu pleaded not guilty to robbing a man of two mobile phones and RM200 cash around 4pm on May 18.

Session Court judge Dayang Ellyn Narisa Abang Ahmad released him on RM8,000 bail with RM1,000 cash to be deposited with the court in two local sureties pending the disposal of the case.

He will be tried in the same court on August 20 and 21, while the pre-trial case management was set for July 22.

Gang robbery comes under Section 395 of the Penal Code and carries a maximum penalty of 20 years' jail on conviction.

The brief fact of case stated that a complainant reported that a man he knew as Wak Jedi had entered his rented room and took his mobile phones.

In his bid to stop him from getting the phones the suspect hit him and grabbed his wallet before he fled with another person who was waiting outside the house on a motorbike.

The complainant immediately lodged a police report which led to Norsalihmin being picked from his house on June 21.

Inspector Austin Patrick Angkon prosecuted.

Property consultant charged with using fake documents in land deal

SHAH ALAM: A property consultant pleaded not guilty in the Sessions Court here yesterday to using two fake documents in a land deal at Dengkil, Sepang, last March.

Ariffin Ab Hamid, 45, is jointly accused with Mohamad Yaacob Markom, 55, a former Selangor Land and Mineral surveyor of using fake Power of Attorney and Sale and Purchase Agreement documents in the transaction between Prestasi Tulin Sdn Bhd and Sunshine Haven Sdn Bhd.

The accused and Mohamad Yaacob who was charged on June 11, allegedly committed the offence at the office of Messrs Abdul Aziz & Associates at No 68A, Jalan Nova U5/N, Nova Business Centre, Subang Bestari here around 11.30 am on March 7.

Judge G. Ramesh set bail at RM13,000 and July 8 for re mention; he also ordered the accused to report to the police station at Seksyen 15 on the third Sunday of every month pending disposal of the case.

Deputy public prosecutor Izalina Abdullah appeared for the prosecution while counsel Khadzar Yusof represented the accused. — Bernama

Nightclub operator fined for exceeding opening hours

KOTA KINABALU: A nightclub operator was fined RM6,000, in default, three months' jail by the Magistrate's Court here yesterday for exceeding the operating hours of the outlet.

Yap Kian Cheng, 41, pleaded guilty before magistrate Cindy Mc Juce Balitus, to operating the entertainment outlet in Penampang on April 13 this year, at 3.45am, beyond the business operating hours as stipulated in the business license issued under the Public Entertainment Ordinance 1958.

The charge framed under Section 11 of the Public Entertainment Ordinance 1958 carries a fine of up to RM50,000, or a maximum of 12 months' jail, or both, on conviction.

Meanwhile, Barsima Maruji, 46, was fined RM7,000, in default, eight months' jail by the same court after she pleaded guilty to possessing 2.85 grams of syabu.

Barsima admitted to possessing the drugs on April 11, this year at the roadside along Kampung Bukit Nenas.

The charge framed under Section 12 of the Dangerous Drugs Act 1952 is punishable with a fine of up to RM100,000 or imprisonment of up to five years, or both, upon conviction.

In the next case, Ambrose Peter Ragut, 39, was jailed four months for trespassing into a furniture shop along Jalan Tuaran, on May 25 this year at around 2 am.

The offence stipulated under Section 448 of the Penal Code is punishable with imprisonment for a term which may extend to one year or with a fine which may extend to RM2,000, or both.

Inspector Azaman Hamat prosecuted in all the cases.

Businessman fined for threatening contractor

KOTA KINABALU: A businessman was fined RM25, in default, one day's jail by a Magistrate's Court here yesterday for threatening to break the leg and hand of a contractor.

Magistrate Stephanie Sherroon Abbi imposed the fine on Stephen Teo, 51, after he pleaded guilty to committing the offence in front of a restaurant in Lido on June 10.

The unrepresented accused admitted to making a call to the victim and threatened to hire a person for RM10,000 to break his leg and hand and also for sending him a SMS stating that even if the victim ran away, he could locate him.

The offence framed under Section 8 (1) (e) of the Minor Offences Ordinance carries a maximum fine of RM25, upon conviction.

Prosecuting officer Inspector Syahrin Ali told the court that the motive of the accused in making threats at the victim was because he was dissatisfied with the additional payment of RM17,000 asked for by the victim to renovate his (the accused's) house.

Syahrin also said that investigation revealed that in March this year, the victim had entered into an agreement with the accused to renovate his house for RM140,000 and it is 90 percent completed.

However, at the last minute, the accused made changes to the design of the house, especially to the toilet, windows and floor which would cost an additional RM17,000. When the victim requested the amount from the accused, he refused to pay but instead made the threat against him.

Based on information provided, the accused was arrested on June 16 and he admitted to have threatened the victim.

In pleading for a light sentence, the accused said that he became angry when hearing the explanation from the victim. He also said that the renovation of his house was only 50–60 per cent completed.

The prosecution pressed for the maximum sentence to be imposed on the accused.

In an unrelated case, six people, including a woman, were fined by the Traffic Court here yesterday for driving their vehicles while under the influence of alcohol.

Ireneus Tidong, 27, and Jeroquel Mapanao, 33, were each fined RM1,000, in default, one month's jail and Roxanne Wong Ling Yee, 28, Jupilon @ Clarence Molijol, 58, Pravinder Singh Ghoman, 28, and Jaharuddin Kaddas, 32, received a RM1,500 fine each, in default, three months' jail.

Ireneus, Jeroquel pleaded guilty before magistrate Stephanie Sherroon Abbie, while Roxanne, Jupilon and Pravinder and Jaharuddin admitted to committing the offence before magistrate Cindy Mc Juce Balitus.

All the accused were charged under Section 45A (1) of the Road Transport Act 1987 (Amendment 1994) which provides for a fine of not less than RM1,000 and not more than RM6,000 and a jail term of up to 12 months, upon conviction.

They were apprehended during traffic operations along Jalan Lintas, Jalan Kolam, Jalan Bundusan and Jalan Coastal between April 18 and June 28.

Traffic prosecuting officer Inspector Hanif Mamyudi appeared for the prosecution.

Man claims trial to three counts of CBT

KOTA KINABALU: A man pleaded not guilty at the Magistrate's Court here yesterday to three counts of criminal breach of trust (CBT) involving RM13,484.

Syamsu Rizal Umar allegedly committed the offences when he was the assistant head of a residential flat committee.

Magistrate Cindy Mc Juce Balitus set August 25–26, this year for trial and July 16 for management of Syamsu Rizal Umar's case.

On the first count, Syamsu, 50, as a person entrusted to collect monies, was alleged to have embezzled a collection of RM4,100 meant to pay the water bills of the residents. The offence was alleged to have taken place between February 18, 2013 and June 12, 2013 at a flat unit of Taman Sri Indah, Jalan Sepanggar, Menggatal.

On the second and third charges, he was alleged to have embezzled RM5,276, and RM4,108, respectively, between February 12, 2013 and June 12, 2013.

The charges framed under Section 407 of the Penal Code provide for imprisonment of up to ten years, and with whipping, and shall also be liable to a fine upon conviction.

The court released him on RM3,000 bail with two local sureties.

Inspector Azaman Hamat acted for the prosecution while the accused was unrepresented.
