German court jails mother who killed her three children

A German court Thursday jailed for 14 years a mother who killed three of her children, a young daughter and twin babies, in a forest before a failed suicide attempt.

The mentally unstable 39-year-old mother, a bakery saleswoman identified only as Bianca T., first strangled her six-year-old daughter, then smothered the four-month-old twins.

The woman acted in the throes of desperation after the twins' father committed himself to a psychiatric ward for depression and she could not convince him to return home.

In harrowing testimony, the court heard how the terrified six-year-old, Anna-Lea, had struggled and pleaded for her life, saying "Mama, I don't want to die, not today, maybe tomorrow".

After the attacks on November 13 last year, the woman intended to take her own life and headed, with the children's bodies in her car, straight for a carpark to jump off the roof, having sent her partner text messages about the killings.

The man called police who then spotted the woman in her car, leading to a high-speed chase. The woman deliberately crashed in a suicide attempt but walked away almost unscathed from the wreck, the court in Landshut, southern Germany, was told.

After her arrest, the mother confessed, claiming to have smothered the twins — a boy and a girl named Fabian and Lisa — but an autopsy later found both had also suffered fractured skulls and the boy broken limbs.

Anna-Lea and Fabian were declared dead in hospital, where surgeons attempted to save the life of Lisa before she too died of her injuries.

"I'm sorry, I'm so sorry," the woman said in tears in court, testifying that she had acted without a clear motive.

"I committed these acts, I know… But it's as if it wasn't me. It's like I was outside of myself," said the woman, who has had a total of six children from three fathers.

Prosecutors had demanded a sentence of 14 years and six months on murder and manslaughter charges for the woman, and the defence 13 years.

No appeal was scheduled.-AFP

Teacher acquitted of sodomy

KOTA KINABALU: A local teacher was acquitted and discharged by the Sessions Court here yesterday from two counts of sodomising his male pupil.

Judge Ishak Bakri freed Jaini Mahrop, 43, without calling for his defence after the judge ruled that the prosecution had failed to establish a prima facie case against the accused.

On the first to second counts the accused was alleged to have committed carnal intercourse against the order of nature on his 12-year-old pupil at the sport store of a school in Beaufort in May and June, respectively.

The two charges were framed under Section 377C of the Penal Code which provides for a jail term of between five years and 20 years and also liable to whipping, upon conviction.

Meanwhile, Jaini, who was represented by counsel Hamid Ismail, was ordered to enter his defence on another three charges of inciting the same victim to an act of gross indecency.

The court held that the prosecution had made out a prima facie case against Jaini.

The accused had allegedly committed the offences in his room at the school and at a sport store of the school between May and Sept 13.

He was charged under Section 377E of the Penal Code which is punishable by a jail term of up to five years and also liable to whipping, upon conviction.

Ishak fixed the hearing to resume on January 6 next year for the accused to enter his defence.

The accused who is also the school Senior Assistant for Curriculums is currently on bail of RM8,000 with two local sureties, pending disposal of the case.

Deputy public prosecutor Wan Azwan Aiman Wan Fakhruddin prosecuted.

This case was first brought to court on November 27, 2012.

Indonesian gets 16 months’ jail over fake Mykad

KOTA KINABALU: An Indonesian security guard was jailed 16 months by the Magistrate's Court here yesterday for possessing a fake Mykad.

Senior assistant registrar Dzul Elmy Yunus imposed the sentence on Samriadi Mohammad, 31, after he pleaded guilty to having the fake identity card bearing numbers 820615-12-6424 under the name of one Muslimin Rasia.

The accused was convicted under Section 25 (1) (e) of National Registration Regulations 1990 which provides for a jail term of up to three years or a fine of not less than RM3,000 and not more than RM20,000, upon conviction.

In imposing the sentence, Dzul Elmy, who sat as a magistrate, held that this case was a serious one taking into consideration the recent case involving an Indonesian security guard in the Peninsula Malaysia.

The unrepresented Samriadi was caught committing the offence at the security hut of an apartment in Penampang on November 24.

The court also ordered the MyKad to be disposed by the National Registration Department and the accused to be referred to the Immigration Department for deportation.

In mitigation, the accused prayed for a lenient sentence and told the court that before he was arrested, he earned a living as a security guard.

He also said that he had been using the MyKad for one year and he bought it from someone.

Prosecuting officer Inspector Lim Swee Beng pressed for an adequate sentence and applied for the accused to be referred to the Immigration Department for further action.

Security guard claims trial to exposing private parts to salesgirl

KOTA KINABALU: A local man claimed trial at the Magistrate's Court here yesterday to a charge of showing his private parts to a 20-year-old salesgirl.

Firdaus Majok, 30, who was brought before senior assistant registrar Dzul Elmy Yunus, who presided as a magistrate, was alleged to have committed the offence in front of a shop at a shopping center here between 6 – 8 pm on October 30.

The offence was framed under Section 509 of the Penal Code which is punishable by a jail term of up to five years or a fine or both, upon conviction.

The court reserved December 6 for case management and released the accused, a security guard, on bail of RM2,500 with two local sureties, pending disposal of the case.

In a separate case, local Marjiebin Mohd Haidir, 22, was charged in the same court with molesting a woman aged 22.

The accused, who works as a driver, had pleaded not guilty to touch the victim's leg, stomach and kissed her neck at a ward of a hospital here at 2pm on November 24.

The offence was framed under Section 354 of the Penal Code which provides for a maximum jail of 10 years or with a fine and whipping, upon conviction.

The court fixed December 6 for the case management and granted the accused bail of RM2,500 with two local sureties.

Prosecuting officer Inspector Lim Swee Beng appeared for the prosecution.
