Accounts clerk charged with embezzling RM30,500

KOTA KINABALU: An accounts clerk was charged in the Sessions Court here yesterday with misappropriating RM30,050.

Amura Albert pleaded not guilty to the charge before judge Dean Wayne Daly who fixed April 16, this year for pre-trial case management.

He had allegedly embezzled the funds through the use of a Maybank card under the name of one, Wong Kin Foo, owner of a travel agency, at the office of the company here between Dec 10, 2013 and Feb 17, 2014.

The charge under Section 408 of the Penal Code provides for a jail term of up to ten years, with whipping, and shall also be liable to a fine, upon conviction.

Deputy public prosecutor Nartiah F Mirchelle Sambatan acted for the prosecution while the accused was unrepresented.

He was released on RM30,000 bail with RM15,000 to be deposited immediately, and two local sureties.

Three locals fined for drunk driving

KOTA KINABALU: A woman and two men, all locals, were each fined RM2,000 by the Traffic Court here yesterday for driving their vehicles while under the influence of alcohol.

Deputy registrar of the High Court, Ryan Saangiraan Rayner Jr, imposed the fine on Azarinah Adnan, 26, Li Kok Yung, 30, and Frederic Kopoh@ Kapoh, 32, after they pleaded guilty to each of their charges framed under Section 45A (1) of the Road Transport Act 1987.

The indictment carries a maximum fine of RM6,000 or with a jail term of up to 12 months upon conviction.

Rayner Jr, who presided as a magistrate, ordered Azarinah to be jailed for one month while Li and Frederic to be imprisoned for two months if they failed to pay their fines.

Traffic prosecuting officer Inspector Hanif Mamyudi told the court that the three accused were arrested during an operation at Jalan Bundusan on January 26.

In an unrelated case, a local man claimed trial to a charge of carrying a knife in public place.

Shahrizal Fendi, 20, was charged under Section 6 (1) of the Corrosive, Explosive and Dangerous Weapons Act 1958 (Amendment 1988) for carrying the dangerous weapon at a park here at 12.10am on March 14.

The offence is punishable by a maximum two years' jail and also liable to whipping upon conviction.

The court set April 25 this year to re-mention the case and released the accused on RM3,000 bail with two local sureties pending disposal of the case.

Prosecuting officer Inspector Syahrin Ali prosecuted while the accused was unrepresented.

Fake ICs land couple in jail

KOTA KINABALU: A married couple was sentenced by the Magistrate's Court here yesterday to one year's jail for possessing fake identification cards.

Rasid Hamdun, 39, and Saadah Tani, 32, had pleaded guilty before magistrate Ryan Sagirann Rayner Jr to their respective charges.

Rasid admitted to holding a MyKad bearing the serial number 750414-12-8393, while Saadah was in possession of a MyKad with numbers 811015-12-6224, on March 13, this year, in front of the Kota Kinabalu Police Headquarters building.

The charge under Section 25 (1) (e) of the National Registration Regulations 1990 carries a fine of between RM3,000 and RM20,000 or three years' jail, or both, on conviction.

Both the cases were prosecuted by Inspector Syahrin Ali.

In another court, magistrate Zaiton Anuar imposed five months' jail on Jari Kaminlian, 34, after he pleaded guilty to committing a similar offence.

He admitted to possessing a fake MyKad (800811-12-6201) bearing his name, on March 13, this year at a residential area in Sepanggar, Menggatal.

Prosecuting officer Inspector Lim Swee Beng prosecuted the case.

All the accused were ordered to be referred to the Immigration Department after serving their sentences.

Husband jailed for wife’s death from acid attack

KUCHING: A former serviceman was sentenced to six years and six months' jail after his wife succumbed to injuries caused by his splashing acid on her.

Father of five Jirem Anas, 50, pleaded guilty before Sessions Court Judge Allaudeen Ismail who convicted him for culpable homicide not amounting to murder (manslaughter), an offence under Section 304 of the Penal Code.

Allaudeen said: "Hopefully after he served the sentence, he will turn over a new leaf and be a good model to his family."

Jirem splashed formic acid on Christina Nyoher, 43, at their village Kampung Simpang Pejiru Bogag in Bau at about 11pm on July 8 last year. The motive was jealousy.

The brief facts of the case stated that Bau Police Station received a call from Bau Hospital informing them a female patient (Christina) was in a critical condition following injuries on her face and all over his body.

It reported that the victim's husband (Jirem) was also admitted to hospital and was in critical condition from consuming weed killer after injuring his wife.

According to police investigations, Jirem was jealous as he suspected his wife was having affairs with a few men, and they used to quarrel about it.

Investigation revealed that prior to the incident, the couple had a heated argument in their bedroom, during which Jirem went berserk, grabbed a bottle of formic acid from the kitchen and splashed it on his wife's face and body.

Screaming in pain, the victim awoke her mother sleeping in the room next door.

On seeing her daughter in pain, the mother realised that she had been splashed with acid.

Jirem ran to his car parked in front of the house and pouring petrol on the car seat, set it alight in his second suicide bid.

Their sons sent their mother to Bau Hospital but on returning home, found their father lying unconscious at the balcony so they also rushed him to hospital.

Both Jirem and wife were later referred to SGH for further treatment following the seriousness of their injuries.

His wife was pronounced dead on Sept 18 last year from pneumonia and when her burns became infected.

Following the incident, Jirem was arrested at his house at about 10.30am on Sept 7 last year.

In mitigation, the accused said his act had cost him his income and subsequently hardship to his family.

He said he was remorseful and had cooperated in the investigation so pleaded for a lenient sentence.

Jirem said he was still being treated for scars from setting himself alight, and also from consuming weed killer.

In passing sentence, Judge Allaudeen said a life had been lost but he was mindful the accused person had no previous conviction, and would lose his pension if convicted and sentenced by the Court.

"I hereby sentence the accused to imprisonment of six years and six months from the date of his arrest on Sept 7, 2013," he said.

Culpable homicide, under Section 304 of the Penal Code, provides for a maximum 20 years' jail.

Jirem talked to his children after the court proceeding yesterday.

The scar on his face was the result of his second suicide attempt.

DPP Stella Augustine prosecuted while defence counsel Ateng Jeros represented Jirem.

Sarawak man jailed for sex trafficking bid

KOTA KINABALU: The High Court here yesterday jailed a Sarawakian man to four years' jail and RM5,000 fine, in default, six months' jail for attempting to traffic in a Vietnamese woman for sex exploitation.

Chief Justice for Sabah and Sarawak Tan Sri Richard Malanjum imposed the sentence on Wong Kuoh Ming, 38, after setting aside his acquittal on a charge under Section 13 (e) of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007. The charge carries a jail term of between three years and 10 years and a fine upon conviction.

In his decision, he found that the defence by the respondent was bare denial and on the point of his cautioned statement not being challenged by the prosecution.

The judge also held that the respondent did not put his defence to the victim and her friend when they were in court.

He further held that the defence did not challenge the evidence of the victim and her friend and there was a general rule that if material evidence is not challenged, it is deemed to be accepted.

Malanjum, who presided as High Court judge, also said that the defence had failed to cast any reasonable doubt on the charge.

The judge said the offence committed was a serious one and the sentence was a lesson for the respondent.

On May 23, 2012, Wong was freed from the charge of trying to traffic in the woman at an apartment at Jalan Bundusan on October 18, 2011 without calling for his defence.

Following the prosecution's appeal, the respondent was ordered to enter his defence but then acquitted for the second time on January 16, 2013.

Deputy public prosecutor Afzan Abd Kahar represented the appellant and counsel Hamid Ismail defended Wong.

Pakistani remanded pending appeal against acquittal

KOTA KINABALU: The High Court here yesterday granted a remand application against a Pakistani trader pending an appeal against his acquittal on a charge of causing the death of a Kota Marudu girl, Norikoh Saliwa.

Justice Azhahari Kamal Ramli allowed the application by deputy public prosecutor Raja Zaizul Faridah Raja Zaharuddin on the grounds that the respondent, Amir Ali Khan Nawaty, 41, has no valid travel document, as his passport and social visit pass had expired on February 9, 2014 and September 9, 2013, respectively.

The judge held that it was appropriate for the court to order that the respondent be remanded pending the disposal of the appeal.

He said the man's continued stay in Sabah is illegal, making it unsuitable for him to be released on bail.

Raja Zaizul Faridah had filed the application under Section 315 of the Criminal Procedure Code (CPC) for the remand order to be made against Amir, 40, pending the disposal of the prosecution's appeal against the lower court's decision in acquitting him.

On Feb 12, this year the Sessions Court had freed Amir under Section 304 (b) of the Penal Code for allegedly committing culpable homicide not amounting to the murder of Norikoh, 16, in a moving lorry at Jalan Km 2.8 Langkon, Kota Marudu between 11am and 12.30pm on November 25, 2012.

The indictment carries with it a maximum 10 years behind bars, or a fine, or both.

The lower court also ordered Amir to be referred to the Immigration Department for further action as his passport was expired.

Counsel Dato' Rakhbir Singh represented Amir.
