200 hours community service for keeping stolen motorbike

KOTA KINABALU: A local youth was ordered by the Magistrate's Court here yesterday to perform 200 hours community service for dishonestly keeping a stolen motorcycle.

Magistrate Herlina Muse made the order on Richard Nilus, 20, after he pleaded guilty to a charge under Section 411 of the Penal Code, which provides for a maximum jail term of five years and also liable to a fine, upon conviction.

The re-mention of the case was fixed for yesterday for the court to hear a social report on the accused provided by the Welfare Department as the accused was a young offender.

The undefended accused admitted to keeping the stolen item belonging to a 26-year-old local man at Km 26, Jalan Papar Lama on November 4.

In a separate case, a local man was jailed for two months by the same court for trespassing into a hotel.

Albin Nasiran, 22, was convicted under Section 448 of the Penal Code, which carries a jail term of up to five years or with a fine, or both, upon conviction.

The accused, with an accomplice who is still at large, pleaded guilty to breaking into the hotel at Api-Api Centre here at 12.05 pm on December 20.

Baju Kurung thief jailed

LAHAD DATU: The Magistrate's Court here yesterday sentenced a foreigner to 18 months' imprisonment for stealing Baju Kurung.

Umi Karsum Alani, 52, was jailed after she pleaded guilty before Sessions Court judge M.Rajalingam, who sat as a magistrate, to a charge under Section 380 of the Penal Code read together with Section 511 of the Penal Code.

Prosecuting officer Inspector Mohamad Soffi Jalal while prosecuting told the court that the accused was arrested on December 16, 2013 after the shop owner lodged a police report saying that the accused had stolen 12 pieces of Baju Kurung from his shop worth RM838.

Investigation found that the accused pretented to choose clothes before taking a bundle of clothes from a rack and put it inside a black plastic.

However, her act was noticed by the shop's cashier who then handed her to the shop owner.

The accused was ordered to serve her sentence from the date she was arrested and to be referred to the Immigration Department for deportation to her country of origin.

Local duo deny robbery charge

KOTA KINABALU: Two 33-year-old local men pleaded not guilty to a joint charge of armed-gang robbery at the Sessions Court here yesterday.

Judge Azreena Aziz fixed February 24–25, this year for the trial of Hassan Miong and Armudi Asalin.

The duo denied robbing a 24-year-old woman of a vehicle worth RM48,000 in front of a house in Taman Iramanis, Luyang on June 19, 2013, at 8.20pm while armed with a machete.

The charge framed under Section 395/397 of the Penal Code carries imprisonment of up to 20 years and shall also liable to whipping upon conviction.

The court ordered for both the accused to be further remanded in custody pending disposal of their case.

Deputy public prosecutor Dominic Chew Ban Huat prosecuted while both the accused were unrepresented.

Woman jailed for cheating

KOTA KINABALU: The Magistrate's Court here yesterday sentenced a local woman to two years' jail for two counts of cheating involving a total amount of RM16,000.

Magistrate Ryan Sagirann Rayner Jr imposed the sentence on Kee Noorayudah Mohd Ayub, 25, after she pleaded guilty to all the charges.

In the first count, Kee admitted to inducing Noraini @ Aini Talip into giving her RM7,000 for the purpose of helping the victim to buy a house in Taman Layar Impian, Tuaran by posing as the niece of the general manager of the Housing and Town Development Board (LPPB).

The offence was committed on April 17, 2013 at Cyber City 2, Penampang.

The charge under Section 420 of the Penal Code provides for a maximum ten years' jail and with whipping, and shall also be liable to fine upon conviction.

For the second count, the accused induced the same victim to hand over RM9,000 for the purpose of paying a home deposit in April, 2013 around 2pm in Penampang.

The court sentenced Kee to two years' jail for each count and ordered for both the sentences to run concurrently.

Kee has several previous conviction records for cheating.

Prosecuting officer Inspector Syahrin Ali prosecuted the case while the accused was unrepresented.

Woman and man jailed for gang robbery

SIBU: A man and a woman were yesterday sentenced by the Sessions Court here to 10 years' jail after they pleaded guilty to two charges of gang robbery.

Gani Limbai, 31, and Aisah Humairah, 27, were charged under Section 395/397 of the Penal Code, punishable under Section 34 of the same code.

The section provides for a maximum 20 years' jail and liable to whipping.

Gani was ordered to be given eight strokes of the rotan.

Judge Indra Ayub sentenced Gani to 10 years' jail and four strokes of the rotan for each of the charges, the jail terms to run concurrently.

Aisah too was sentenced to 10 years' jail for each of the charges with the sentences to run concurrently.

Another accused, Muhammad Aliff Faisal Muhammad Soleh, 20, pleaded not guilty to the same charges.

His case comes up for trial on Jan 13.

According to the brief facts in the charge sheet, at about 10pm on Oct 20, 2013, Raushan Kumar and his friend Anand Kumar went to see their friend in a hotel at Market Road.

They were approached by four individuals identified as Gani, Aisah, Muhammad Aliff and one still at large downstairs of the hotel.

Muhammad Aliff and the one still at large allegedly pointed a multi-function folding knife at Raushan and Anand.

Then Gani and Aisah took away the passports, handphones, RM700 cash and other items from Raushan and Anand.

On Oct 21, 2013 at about 3.30am, police arrested Gani and recovered a handphone believed taken from Raushan.

Gani told police three of his friends were also involved in the robbery.

Aisah was arrested at the Central Market, which led to the arrest of Muhammad Aliff at Channel Road.

Gani and Muhammad Aliff told police during interrogation that they had put the folding knife on a bed in a hotel.

Later, Raushan and Anand identified the three accused as those who robbed them, and the recovered items as those taken from them.

Trio get two months’ jail for overstaying

SARIKEI: Three Indonesians were yesterday sentenced to two months' imprisonment each by Sibu Sessions Court for overstaying in the state.

The sentence was meted out after the three foreigners, Saeful Bahri, 23, Jamhari, 28, and Nasran Hanafi, 32, pleaded guilty to separate charges framed under Section 15(1)© of the Immigration Act 1959/63 (Ammend. 2002).

According the brief facts of the case read out by prosecuting officer, Inspector Anbarasu Gobi, Saful had entered the state with a social visit pass through Entikong/Tebedu Immigation Post last Oct 22 and had not returned to Indonesia since.

He had overstayed in the state for 28 days until arrested by police in Sarikei around 12.10pm last Dec 19.

Jamhari who entered the state with the same document and Immigation Post on the same date was arrested around 3pm on Dec 19 while Nasran who entered the state with a social visit pass through the same Immigation Post last Sept 1 had overstayed for 2 months and 20 days when arrested at a hotel in Sarikei on the night of Dec 21.

The sentence is to take effect from their date of arrest.
