Former school teacher jailed for CBT

KOTA KINABALU: A former teacher of a primary school was jailed a total of two years and six months by the Corruption Court here yesterday for committing criminal breach of trust in relation to the financial assistance for poor students which was entrusted to him.

Judge Caroline Bee Majanil convicted Othman @ Awang Hj Abd Wahid, 54, who was the students affairs senior assistant attached to Sekolah Rendah Pekan Tuaran, in Tuaran, under Section 409 of the Penal Code.

The indictment carries a jail term of between two and 20 years and with whipping, and also liable to a fine, upon conviction.

The accused was sentenced to two years' imprisonment after he was found guilty of embezzling the financial assistance allocated under the Kumpulan Wang Amanah Pelajar Miskin (KWAPM) for 2008 involving a sum of RM4,250.

He committed the offence at the school between March 2008 and March 2009.

Othman, who was also found guilty of an alternative charge of dishonestly misusing the said money at the same place also between March 2008 and March 2009, received another six months' jail.

The charge was framed under Section 403 of the Penal Code which provides for a jail term of between six months and five years and with whipping and also liable to a fine, upon conviction.

The trial judge, who allowed a stay of execution for Othman pending his appeal at the High Court, ordered the jail terms to run concurrently.

Othman, who was represented by counsel P.J Perira, is currently released on RM10,000 bail, with RM5,000 to be deposited with two local sureties, pending his appeal.

Malaysia Anti-Corruption Commission prosecuting officer Awang Samsul Baharam Bongsu called 21 witnesses to testify against the accused and Othman called three witnesses.

After the decision, the accused, who was said to be accompanied by his brother, was in the courtroom for a long time as he did not want his pictures to be taken by members of the press.

He, however came out later, covered his face with a big envelope, and took cover behind his brother.

Mechanic jailed, fined for threatening man

KOTA KINABALU: The Magistrate's Court here yesterday sentenced a local mechanic to three weeks' jail and fined him RM1,000, in default two months' jail for threatening a man.

Mansur Nurdin, 21, pleaded guilty before deputy registrar of the High Court Ryan Sangiraan Rayner Jr, to threatening the man using a knife at a car accessory shop in Putatan on February 16.

He was convicted under Section 506 of the Penal Code which carries a maximum jail of seven years and also liable to a fine, upon conviction.

The facts of the case stated that the accused, who was a former worker of the victim, came to the shop armed with a knife and caused fear to the complainant.

Investigation revealed that the accused and the victim had a verbal argument and the accused became angry and later took the knife and chased after the victim to the shop.

When they entered the shop, the accused stopped chasing as the victim had taken an iron rod. The accused then left the shop.

In a separate case, an unemployed man received RM2,000 fine, in default, four months' jail by the same court for injuring his uncle.

Fanddy Baidin, 29, admitted to hurting his uncle aged 51 by punching his face twice at a house at Kampung Kayu Madang in Menggatal on September 9, 2013.

The offence was framed under Section 323 of the Penal Code which is punishable by a jail term of up to two years or a fine, upon conviction.

Prosecuting officer Inspector Syahrin Ali told the court that the quarrel broke out when both of them were drinking alcohol and the accused accused the victim of doing something bad to the accused's father a long time ago.

In another Magistrate's Court, a Filipina was fined RM529.60, in default, two months' jail for possessing contraband cigarettes for the purpose of selling them.

Magistrate Zaiton Anuar fined Lajimah Suari, 54, after she pleaded guilty to a charge under Section 135 (1) (d) of the Customs Act 1967 which is punishable under Section 135 (1) (i) (aa) of the same Act.

The indictment provides for a fine of up to 10 times of the value of the seized items or a three years' jail or both, upon conviction.

The accused was caught possessing 12 boxes of cigarettes at Jalan Kampung Air here on March 18.

Local on robbery charge to know fate April 2

KOTA KINABALU: A 29-year-old local man will know his fate on April 2 at the Sessions Court here for robbing three women at a resort, as the case comes up for sentencing.

Judge Dean Wayne Daly put off the sentencing of Mohd Nazib Wata, 29, at the request of deputy public prosecutor Nartiah F. Mirchelle Sambatan.

Nartiah applied for an adjournment to prepare the facts of the case and the victims' impact statements.

The undefended accused admitted to robbing the three women aged between 20 and 24 in a room at a resort in Kinarut, Papar between 3am and 4am on March 16.

The charge, framed under Section 392 of the Penal Code, also stated that the accused took a digital camera and two smartphones.

It carries a jail term of up to 14 years and also liable to a fine, upon conviction.

The accused was denied bail and ordered to be remanded further pending disposal of his case.

In a separate case, the same court extended an arrest warrant of an IMM13 holder who faces an armed robbery charge.

Nartiah told the court that the warrant of arrest against Rizkhana Halim, 43, was not executed.

The court then set April 22 to review the warrant of arrest for the second time and notices to the accused's sureties were also issued.

The accused was alleged to have committed the robbery of a cellphone belonging to a woman aged 44 with two accomplices who are still at large, using a machete at a car park in front of a nursery clinic in Lintas at 3,40pm on May 8, 2012.

He was charged under Section 395 of the Penal Code, read together with Section 397 of the same Code, which carries a maximum jail of 20 years and whipping, upon conviction.

The warrant of arrest was first issued on February 20.
