Remand of trio over shooting spree extended

KOTA KINABALU: The Magistrate's Court here extended for two days an order to remand three local men, aged between 25 and 36, who police believe were involved in the drive-by shooting spree around the state capital recently.

Magistrate Herlina Muse granted the application to extend the remand period of the mechanic, tow truck driver and workshop owner, made by prosecuting officer Inspector Azaman Hamat.

The remand order was issued in chambers under Section 117 of the Criminal Procedure Code to facilitate police investigation into their alleged involvement in the shooting incident.

The case is being investigated under Section 32 of the Arms Act 1960 on offence for use and possession of arms and imitation arms in certain cases.

According to their counsel, P.J Perira, the suspects have just been released on police bail on February 4 from a six days remand at the Penampang police station.

However, the police had filed an application to extend the remand for another two days at the Karamunsing police station, he added.

In the incident on January 10 this year, a group of individuals believed to be teenagers caused unnecessary public alarm when they went around shooting at 46 premises in the state capital with what the police believed were air guns loaded with marbles.

The group was said to have moved around in three vehicles shooting at premises along their way with the air guns in the city centre, Inanam, Luyang and Penampang between 11.45pm on January 10 until 6am on January 11.

The premises affected were banks, hotels, beauty salons, restaurants, offices, a petrol station, car showrooms and shopping malls with losses estimated in the hundreds and thousands of ringgit.

No known casualty was however reported in the incident, which reportedly brought about some degree of panic and apprehension in the social media networks, i.e. Facebook and WhatsApp.

On January 29, this year, police arrested five individuals who they believe would be ableto assist them in the investigation of these cases.

16 individuals now charged in court in Genneva case

KUALA LUMPUR: Another Genneva (M) Sdn Bhd director was charged at the Sessions Court here yesterday for illegal deposit-taking amounting to RM5.5 billion, bringing the number of individuals charged in the gold investment case to 16 so far.

Ahmad Khairuddin Illias, 55, pleaded not guilty to two counts of illegal deposit for a gold scheme, under Section 25(1) of the Banking and Financial Institutions Act 1989, which is punishable by up to 10 years jail or maximum of RM10 million or both, upon conviction.

He is accused of committing the offence through two current accounts at CIMB Bank Berhad, Jalan Kuchai Lama branch here between Jan 10 2011 and Oct 1 2012.

Bank Negara Malaysia (BNM) prosecuting officer Fahmi Abd Moin applied for Ahmad Khairuddin's case to be tried jointly with the 15 other individuals charged earlier. Judge Mat Ghani Abdullah set bail at RM500,000 with one surety and ordered the accused's passport to be impounded.

The court also scheduled Feb 20 for mention and submissions on the prosecution's application for the all the cases to be jointly tried.

Lawyer Mohd Hairani Samsi represented Ahmad Khairuddin.

Between Sept 2013 to date, BNM has charged 16 individuals, including the accused, and 10 companies on 1,550 counts in relation to gold investment schemes amounting to RM5.5 billion. — Bernama

Two men plead not guilty to robbery

KUCHING: Two men charged with robbery pleaded not guilty before the Sessions Court here yesterday.

Judge Allaudeen Ismail fixed Feb 12 and 13 for hearing.

The duo, Mohd Azlan Mohd Sazali, 29, and Mohd Luzhahski Zaimi, 24, are charged with attempting to rob a Japanese national, Chikushi Setsuo, at gun-point at Jalan Kenny Hill here about 8.20am Jan 13.

They are charged under Section 4 of the Firearms (Increased Penalties) Act 1971, and punishable under the same section and read together with Section 34 of the Penal Code, which carries a life imprisonment and caning on conviction.

Mohd Azlan will also be tried under Section 9 of the Firearms (Increased Penalties) Act 1971.

He was caught together with Mohd Luzhahski who possessed a Walther P99 pistol bearing serial number RMP15669 when arrested at 9.50am at Jalan Jambatan Gantung here.

Mohd Luzhahski will be tried under Section 8 of the Firearms (Increased Penalties) Act 1971.

Both charges carry an imprisonment term which may extend to 14 years with not less than six strokes of the cane on conviction.

Main suspect in 2-year-old Nur Syafiqah’s murder case pleads not guilty to two charges

DUNGUN: The main suspect in the case of a two-year-old girl who was found murdered in a vacant house in Paka here pleaded not guilty to two charges at the Magistrate's Court here yesterday.

On the first count, unemployed Soffian Hadie Mohd Nor, 35, was accused of failing to present his identity card to the police when he was detained at the Fisheries Development Board office, Kuala Paka at 1.30 pm on Jan 21.

As for the second count, he was charged with abusing and neglecting Nur Syafiqah Adawiyah Abdullah, 2, who was in his care, at Lot 8428, Taman Perumahan Seberang Paka Fasa 2, Paka about 3.20 pm on Jan 22.

The accused, who has a prior criminal record for drug abuse faces up to 10 years imprisonment, maximum fine of RM20,000 or both, upon conviction under Section 31(1)(a) of the Child Act 2001.

Magistrate Hazwanie Husain Bustari denied bail to the unrepresented accused, whom the prosecution may charge with murder under Section 302 of the Penal Code, depending on the outcome of the forensics and chemist reports.

Meanwhile, the victim's mother Rabiatul Adawiyyah Mamat, 28, was also charged in the same court with lodging a false report that her child was missing, at the Paka police station at noon on Jan 18.

Attired in a red dress and black scarf, the unaccompanied woman pleaded not guilty to the charge under Section 192 of the Penal Code and was unable to pay the RM6,000 bail which was offered by the magistrate.

The court scheduled March 5 for remention of all the charges.

3 Indonesians fined for overstaying

MIRI: Three Indonesian labourers were each sentenced to between three and four months imprisonment by the Sessions Court here yesterday for overstaying in the state.

The court also ordered them to be referred to the Immigration Department for the next course of action after serving their sentence.

Deputy Registrar Nasrul Hadi Abdul Ghani imposed the sentence after considering several factors including the guilty plea and mitigation of the three accused, fact of case, offence and public interest.

Talip, 23, from Entiti Timur, Kammisi Daeng Nai, 25, from Makasar and Yasir Semmang, 26, from Bune, Sulawesi
Selatan, Indonesia are charged under Section 15 (1) (c) of the Immigration Acts 1959/63 (Amendment 2002) and punishable under Section 15 (4) of the same Act.

The trio are liable to a RM10,000 fine, in default five years jail or both if found guilty.

They were apprehended on suspicion of being foreigners at 4.30pm on Jan 23 at an oil palm plantation in Niah by a police party from Niah Police Station led by Inspector Gilbert Cinhin Simunga.

The investigation found that Talip's social visit pass had expired on Oct 11 last year while that for Kammisi and Yasir on April 12, 2012 and May 13, 2013 respectively.

The trio pleaded for leniency and asked to be deported to their country of origin.

Talip and Yasir were each sentenced to three months' jail and Kammisi to four months.
