Posted on December 4, 2013, Wednesday KOTA KINABALU: At the Sessions Court here yesterday, a self-employed local man was ordered to enter his defence on an illegal logging charge. Judge Ismail Brahim fixed January 27–28, 2014 for Joseph Damit Undikai's defence trial. The 47-year-old accused was accused of having in his possession timber logs and woodchips that were allegedly extracted from State land without permission from the Forestry Department or any other relevant authority. The offence was allegedly committed on May 9, 2012, at 3pm, at an unmarked house in Kampung Marabahai, Tuaran. The charge framed under Section 30 (1) (g) of the Forest Enactment 1968 and punishable under Section 30 (2) (b) of the same Act carries a fine of up to RM500,000 or maximum of five years jail, or both, upon conviction. The court, however, discharged and acquitted Joseph of a second charge which accused him of setting up an illegal sawmill at the same place and time. The charge framed under Section 19 (1) and punishable under Section 33 (1) of the same Act carries a maximum penalty of RM50,000, or a jail term of up to five years, or both, on conviction. Prosecuting officer, Peter Maurice Lidadun, acting for the Forestry Department, had called a total of ten witnesses during trial which commenced on April 15, this year. | Filipino jailed, whipped for illegal entry Posted: 03 Dec 2013 10:45 AM PST LAHAD DATU: The Sessions Court here yesterday sentenced a Filipino to five months' imprisonment and to be given six strokes of cane for entering Sabah illegally. Jafar Abdullah, 37, who pleaded guilty to committing the offence at Jalan Masjid Raya, Kunak on August 15, this year, was also ordered to serve his sentence from the date of arrest. Judge M. Rajalingam convicted Jafar under Section 6 (1) (c) of the Immigration Act 1959/63 (Amended 2002), punishable under Section 6 (3) of the same Act. Prosecuting officer, Inspector Mohamad Soffi, told the court that Jafar was arrested after he failed to show any valid identification when apprehended by police personnel. The court also ordered the accused to be referred to the Immigration Department after serving his sentence for deportation to his country of origin. | Man jailed over knife, break-in Posted: 03 Dec 2013 10:45 AM PST Posted on December 4, 2013, Wednesday TAWAU: A 34-year-old jobless man was sentenced to a total of 22 months' jail and one stroke of the cane by the Magistrate Court here yesterday for possession of a knife and housebreaking. Magistrate Ferhanshah Farene meted out the sentence on Amir bin Isnin who pleaded guilty to the charge under Section 6(1) of the Corrosive, Explosive and Dangerous Weapon Act and Section 457 of the Penal Code. Ferhanshah sentenced the accused to seven months' jail for possession of a 7-inch knife and fifteen months for trespassing and stealing a Toshiba laptop. Both the sentences are to run from the date of arrest on November 29 this year. The accused was caught by a security guard with the stolen laptop and the knife tucked in his pants at about 4:35pm at Kuhara Court. | Appeal against conviction for manslaughter dismissed Posted: 03 Dec 2013 10:43 AM PST KOTA KINABALU: The High Court here yesterday dismissed an appeal by a local man against his 12 years' jail for manslaughter. Justice Ravinthran Paramaguru upheld the sentence of Marius Ukin, 40, who was convicted by the lower court on April 25 this year. In his decision, Paramaguru ruled that there was no error found in the judgment and there was also no merit in the appeal. The appellant who was defended by counsel Datuk Chau Chin Tang had caused the death of one Aedwin Philip, 43, by kicking his face at a vegetables storehouse in front of a cottage hotel in Kundasang on November 2, 2012. The offence was framed under Section 304 (a) of the Penal Code which carries a maximum jail of 30 years and a fine, uon conviction. Deputy public prosecutor Raja Zaizul Faridah Raja Zaharuddin appeared for the respondent.
