The State government should stop ignoring the decision of the Court of Appeal!

Once again the Court of Appeal has confirmed that "pemakai menua" and "pulau galau" are NCR lands. This was held in a decision handed down to two appeals which were heard together viz; Civil Appeal Superintendent of Lands and Surveys Department Sibu Division & Anor v Usang ak Labit & 3 Ors (which is the appeal herein); and Civil Appeal Rosebay Enterprise Sdn Bhd v Usang ak Labit & 3 Ors. This decision refutes the stand of the present State Government as declared by Tan Sri Adenan Satem, Minister in the Chief Minister's office at the DUN sitting last November when he disclosed that the State Government only recognises "temuda" as NCR land said the Rt. Sekali lagi Mahkamah Rayuan telah mengesahkan bahawa "pemakai menua" dan "Pulau Galau" ialah tanah NCR. Ini telah diputuskan dalam keputusan yang diturunkan kepada dua rayuan yang didengar bersama iaitu; Rayuan Sivil terhadap Penguasa Tanah dan Ukur Bahagian Sibu Jabatan & Anor v Usang ak Labit & 3 Ors (yang rayuan itu di sini); dan Rayuan Sivil Rosebay Enterprise Sdn Bhd v Usang ak Labit & 3 Ors. Keputusan ini sama sekali menyangkal pendirian Kerajaan Negeri sebagaimana yang diisytiharkan oleh Tan Sri Adenan Satem, Menteri di pejabat Ketua Menteri di DUN pada persidangan November lalu apabila beliau memberitahu bahawa Kerajaan Negeri hanya mengiktiraf "temuda" sebagai tanah NCR kata Yang Berhormat Baru Bian, Pengerusi PKR Sarawak dan peguam hak tanah adat.
