Rape: Prosecution fails in bid for heavier sentence

KOTA KINABALU: The High Court here yesterday affirmed the sentence of a local taxi driver for raping a teenage girl.

Judicial Commissioner Azahahari Kamal Ramli dismissed the appeal by the prosecution for the sentence against Abdul Salaman, 40, to be increased.

The respondent, who was unrepresented, was found guilty on September 3, 2013, of raping the 16-year-old girl in a car under a village house in Papar on November 21, 2010.

He was jailed for seven years and also ordered to be whipped once by the subordinate court here.

The offence was under Section 376 (1) of the Penal Code which provides for a maximum jail of 20 years and also liable to whippin, upon conviction.

Deputy public prosecutor Afzan Abd Kahar appeared for the appellant.

Unemployed man jailed for trespassing into palace

KUALA LUMPUR: An unemployed man was sentenced to a total of five months' jail by the magistrates' court here yesterday for trespassing into and committing mischief at Istana Perlis at Jalan Eaton two weeks ago.

Magistrate Saifulakmal Said handed down the sentence on Cheah Hun Chee, who pleaded guilty to the charges.

Cheah, 31, was sentenced to two months' jail for committing mischief and three months' jail for trespassing.

He was also sentenced to a month's jail for failing to produce his identity card when requested by the authority.

However, Cheah was ordered to serve the sentence concurrently from the date of arrest, which was Dec 12.

Cheah had plead guilty to trespassing into Istana Perlis and smashing the glass door, as well as vandalising the wall with paint, causing losses worth RM500 at about 3am last Dec 12. — Bernama

Man denies possessing pistol, bullets

KOTA KINABALU: A local man pleaded not guilty to two charges of possessing an air pistol and bullets at the Magistrate's Court here yesterday.

Deputy registrar Amir Shah Amir Hassan, presiding as magistrate, fixed January 16, 2014 for the case management of Eddy James @ John, 35.

In the first charge, Eddy denied owning the air pistol without a proper licence at a shop lot at Country Heights, Penampang on December 17.

The offence, under Section 8(A) of the Arms Act 1960, carries a jail term of up to ten years, or to a maximum RM10,000 fine, or both, on conviction.

On the second charge, Eddy was accused of owning 132 air pistol bellets without a licence at the same time and place under the same section and Act.

The court released him on RM2,000 bail with two local sureties for each charge.

Prosecuting officer Inspector Lim Swee Beng prosecuted while the accused was unrepresented.

Duo jailed for stealing

KOTA KINABALU: Two men and a woman were charged in the Magistrate's Courts here yesterday with stealing.

Chiew Nyuk Min, 51, and Timorese woman Rosalina Lelu, 35, were sentenced to four and 10 months' jail each after they pleaded guilty to each of their charges under Section 380 of the Penal Code, while Mohd Said Sabari, a 34-year-old local, claimed trial to committing a similar offence.

The offence is punishable by a maximum jail of seven years and also liable to a fine upon conviction.

Chiew, who was brought before deputy registrar of the High Court, Ryan Sangiraan Rayner Jr, who sat as a magistrate, admitted to stealing the cellphone of a woman at a house in Taman Luyang on August 30.

Meanwhile, Rosalina, who appeared before deputy registrar of the High Court, Amir Shah Amir Hassan, had stolen 11 pieces of cloth that belonged to a supermarket at a shopping complex in Luyang on December 12.

Amir Shah, who presided as a magistrate, also ordered Rosalina to be referred to the Immigration Department for further action after serving her sentence as she had no valid travel documents.

Mohd Said had allegedly stolen a trolley and two bottles of drinks, all valued at RM719.50, at a supermarket of a shopping mall here at 10.20am on December 19.

Amir Shah reserved January 10 next year for case management and released Mohd Said on RM2,500 bail with two local sureties.
