Feb 14 verdict for teacher over pupil’s indecent acts

KOTA KINABALU: The Sessions Court will deliver its verdict on February 14 against a local teacher who was tried on three charges for inciting an underage boy to commit acts of gross indecency.

Judge Ishak Bakri fixed the date to deliver his judgment on Jaini Mahrop, 43, at the end of his defence trial here yesterday.

The accused had allegedly performed obscene acts on his 12-year-old pupil in his room in the school where the accused taught and at the sports store of the school between the months of May and September, 2012.

He was charged under Section 377E of the Penal Code which is punishable by a jail term of up to five years and also liable to whipping, upon conviction.

On November 28 this year, the same court had discharged and acquitted Jaini on two counts of sodomy involving the same victim, alleged to have taken place at the same place and time.

The two charges were framed under Section 377C of the Penal Code which provides for a jail term of between five years and 20 years and also liable to whipping, upon conviction.

The court, without calling Jaini to enter his defense, ruled that the prosecution had failed to prove a prima facie case against him.

The accused who is also the school Senior Assistant for Curriculums is currently on bail of RM8,000 with two local sureties, pending disposal of the case.

Deputy public prosecutor Wan Azwan Aiman Wan Fakhruddin prosecuted while counsel Hamid Ismail acted for the accused.

This case was first brought to court on November 27, 2012.

Woman gets another 5 years’ jail for cheating

KOTA KINABALU: An unemployed local woman, who is now serving her sentence for cheating convictions, received another five years' jail for committing a similar offence.

Deputy registrar of the High Court Amir Shah Amir Hassan imposed the sentence on Kee Noorayudah Mohd Ayub, 26, after she pleaded guilty to the charge framed under Section 420 of the Penal Code, which provides for a maximum jail of 10 years and whipping and also liable to a fine, upon conviction.

The undefended accused admitted to deceiving a woman aged 31 of RM3,000 by saying that it could help to process a Housing and Town Development Board's (LPPB) house at Taman Inanam Jaya in Kiansom.

The offence was committed at a nursery in Menggatal on September 28.

Amir Shah, who presided as a magistrate, ordered the accused to serve her jail term from yesterday.

In an unrelated case, a 26-year-old man was sentenced to nine months' imprisonment for possessing another person's MyKad.

Mohd Anih Hamma Manggi admitted to carrying the identity card under the name of one Mohd Basri Ambuk bearing the numbers 880329-49-5343 at the departure hall of Terminal 2, Kota Kinabalu International Airport here on December 9.

The offence was under Regulation 25(1)(o) of the National Registration Regulations 1990 which provides the same punishment.

The court ordered the accused to be referred to the Immigration Department for further action after serving his jail sentence.

Prosecuting officer Inspector Lim Swee Beng prosecuted.
