Milkman denies raping 12-year-old Posted: 13 Dec 2013 09:32 AM PST KOTA KINABALU: A local milkman was charged in the Sessions Court here yesterday with raping a 12-year-old girl five months ago. Hezron Maikal, 19, pleaded not guilty before judge Ummu Kalthom Abdul Samad to a charge framed under Section 376 (2) of the Penal Code which provides for a maximum jail of 20 years and also liable to whipping, upon conviction. The accused was alleged to have raped the girl at a room of a farm quarters in Kundasang at 10pm in early July this year. The charge also stated that after having sex, the accused had allegedly threatened to injure the victim's family. The court set Jan 20 this year for case management. The accused was denied bail. Jan 29 D-Day for Pakistani trader over girl’s death Suraini Andokong Posted: 13 Dec 2013 09:31 AM PST KOTA KINABALU: The Sessions Court here will decide on January 29 next year whether the prosecution had established a case against a Pakistani trader charged with causing the death of a girl in Kota Marudu last year. Judge Ummu Kalthom Abdul Samad set the date to deliver her ruling on Amir Ali Khan Nawaty, 40, alleged to have committed culpable homicide not amounting to murder on Norikoh Saliwa, 16, in a moving lorry along Jalan Km 2.8 Langkon from Kota Marudu between 11am and 12.30pm on Nov 25, 2012. He faces a jail term of up to 10 years or with a fine or with both if found guilty under Section 304 (b) of the Penal Code. The ruling will be delivered by Sessions Court judge Ishak Bakri who replace the previous judge Duncan Sikodol, who heard the case. Earlier, counsel Rakhbir Singh, who represented Amir, told the court that he had met his client in prison and that his client had indicated to him to request a replacement of the previous judge to hear the case. Deputy public prosecutors Raja Zaizul Faridah Raja Zaharuddin and Afzan Abd Kahar, during the trial from February 7 to September this year, had called more than 10 witnesses to testify against Amir Ali, including the father and the sister of the deceased. The accused is currently detained in custody under Section 259 of the Criminal Procedure Code, pending disposal of the case. Syiah: 17 contract marriage applications in rural Sabah Posted: 13 Dec 2013 09:29 AM PST Posted on December 14, 2013, Saturday KOTA KINABALU: Sabah mufti Bongsu @ Aziz Jaafar said the Syiah movement in Sabah has allegedly spread in rural areas where the district offices received 17 applications for muta'ah (contract marriage) and they were required to take oaths before district officers. He said the spread of Syiah, allegedly through businesses, education, political parties and non-governmental organisations, was being monitored by the authorities. Robbery: Only one accused in court as one shot dead, another paralysed Posted: 13 Dec 2013 09:28 AM PST KOTA KINABALU: The Sessions Court here yesterday set April 1–2 next year for the trial of two men, who were jointly charged with gang robbery three months ago. Judge Ismail Brahim set the hearing date for Wan Ghazali Wan Aria, 30, and Wong Jong Shiun, 32, when their case came up for case management. However, counsel Batholomew Jingulam, the defence counsel for Wan Ghazali and Wong drew the court's attention that another accused in this case, Lim Yee Xiang, had died. According to Jingulam, it was learnt that Lim was shot dead while allegedly committing another offence and his co-accused Wong, believed to be paralyzed, has been admitted to a hospital. Only Wan Ghazali was present in court. Jingulam then applied to discharge himself from representing Wan Ghazali and Wong. In reply, deputy public prosecutor Nartiah F. Mirchelle Sambatan requested for Lim's death certificate as well as a medical certificate to confirm that Wong is paralyzed. Wan Ghazali from Petaling Jaya, Selangor, Lim of Sri Damansara, Kuala Lumpur and Wong from Kepong, Kuala Lumpur were released on court's bail during their first arraignment in court. The three accused persons were alleged to have robbed a woman of two laptops, two necklaces, two wristwatches, two cellphones, a Tab, a travelling bag and RM150 in cash at a house at Taman Bukit Sepanggar at about 11.35am on October 4. They were jointly charged under Section 395 of the Penal Code which carries a maximum jail of 20 years and also liable to whipping, upon conviction. In a separate case, Filipino Azmin Suharto, 26, pleaded not guilty to committing a similar offence. He was accused of robbing a 19-year-old man of RM70 at the car park of a shopping complex here at 3.30pm on December 7 with another two accomplices, who are still at large. The court fixed January 13 next year for case management and denied bail to the accused who has no valid travel document.
