Man denies attempt to murder cop Posted: 06 Feb 2014 04:41 PM PST KOTA KINABALU: A jobless man was charged at the Sessions Court here yesterday with attempting to murder a local police officer with a vehicle. Jerry Abdul Halim, 30, pleaded not guilty before Judge Dean Wayne Daly to the charge of attempt to run over Corporal Razi Gapar, 36, with a Toyota Land Cruiser on December 12, 2013 in front of Malar Hotel, Kampung Air. The unrepresented accused was charged under Section 307 of the Penal Code which is punishable with up to 20 years jail, upon conviction. The court fixed March 12, this year for the next mention of his case. Deputy public prosecutor Nartiah F Mirchelle Sambatan had objected to the granting of bail on the grounds that the accused possesses no proper documents and therefore have a high probability of him absconding. The court then ordered for the accused to be further remanded in custody, pending disposal of his case. In a separate court, Azwan Basir, 18, claimed trial before Magistrate Herlina Muse to a charge of stealing a motorcycle. The accused allegedly stole the motorcycle belonging to Syaid Al Basri, 18, on January 30, this year at Kedai Runcit Indah Permai, Jalan Sepanggar, Menggatal. The penalty for the offence under Section 379A of the Penal Code is maximum seven years jail, and shall also be liable to a fine, on conviction. The court fixed March 6, this year for his trial and denied bail for the accused under Section 259 of the Criminal Procedure Code. Inspector Azaman Hamat prosecuted in the case. Indian with fake IC fined RM8,000 Posted: 06 Feb 2014 04:20 PM PST KOTA KINABALU: An Indian man was fined RM8,000, in default, six months' jail by the Magistrate's Court here yesterday for possessing a fake identity card. Hussain Sahul, 50, pleaded guilty before court registrar Ryan Sangiraan Rayner Jr, who sat as a magistrate, to having the fake MyKad bearing numbers 630520-12-5715 at a bank here at 4.15pm on November 28. He was convicted under Regulation 25 (1) (o) of the National Registration Regulations 1990 which carries a maximum jail of three years or a fine of between RM3,000 and RM20,000, upon conviction. The accused, who earns a living as a cook, was represented by counsel P.J Perira. In a separate case, local Primus Yong claimed trial to a charge of carrying a knife at a public place. The accused was charged under Section 6 (1) of the Corrosive, Explosive and Dangerous Weapons Act 1953 which carries a maximum jail of two years and whipping, upon conviction. He was caught for allegedly having the dangerous weapon at a quarters building in Sepanggar, Menggatal at 4pm on January 29. Rayner Jr reserved February 26 this year to re-mention the case and released the accused on bail of RM2,500 with two local sureties, pending disposal of the case. French woman and two others charged with planting cannabis Posted: 06 Feb 2014 11:03 AM PST KOTA KINABALU: Two people, including a French, pleaded not guilty in the Sessions Court here yesterday to a charge of planting cannabis. French national Melissa Marie Commins, 31, and Jon Stephen Mosundu, 24, are charged with planting the cannabis at No. 302, Signal Hill Tower, Jalan Bukit Bendera here at 11.30am on Jan 29 this year. The charge, under Section 6B (1)(a) of the dangerous Drugs Act 1952, carries a life imprisonment and with whipping of not less than six strokes, if found guilty. Judge Dean Wayne Daly set Feb 27 for mention. Deputy Public Prosecutors Dominic Chew and Nartiah F Michelle Sambathan prosecuted. Meanwhile, in the magistrates' court, Ashley Ng Han, 26,said to be a friend of the two accused, was charged with trafficking 572gm of cannabis and cultivating the cannabis plant at a housing unit at the same condominium on the same day. However, no plea was recorded. Deputy Registrar Ryan Sagiran Rayner JR fixed Feb 18 for mention. Deputy Public Prosecutor Dominic Chew prosecuted in the case. All three accused were represented by lawyers Nelson Angang and Bartholomew Jingulam. March 10 for social report on student charged with making false report Posted: 06 Feb 2014 08:26 AM PST KUCHING: A Magistrates' Court here yesterday set March 10 for a social report to be tendered in a case involving a skills training college student charged with making a false police report on Wednesday. The 18-year-old youth appeared before Magistrate Shafiza Abdul Razak Tready who made the order pending the sentencing as the accused is a youthful offender. The youth allegedly between 1pm and 1.30pm at the One Stop Centre of Kuching district police station at Jalan Simpang Tiga on Feb 5 lodged a false police report recorded by Inspector Phillip Kanyai. In his statement he said two men wore mask and, armed with pistol and knife, robbed him in front of his college at Stutong around 10.30am on Feb 5. He claimed that 'the robbers' had shoved a knife at his wrist and pointed the pistol at his head and forced him to surrender a laptop and RM20 cash. According to the investigation officer, the report lodged by the accused caused a stir as it involved a dangerous weapon, a pistol which made it a serious offence. However the police's initial investigation cast doubt on the statement recorded from the accused and he was summoned to the police station for further questioning when he admitted lying. The offence framed under Section 182 of the Penal Code provides for an imprisonment up to six months or fine, or both upon conviction. Court fines man for assaulting woman Posted: 06 Feb 2014 08:24 AM PST Posted on February 7, 2014, Friday SARIKEI: A Magistrates' Court here fined a 26-year-old man RM1,000 in default two months in prison after he pleaded guilty to injuring a 58-year-old woman on Oct 25. Lau Puong Hiing attacked the woman while she was involved in a heated argument with his father at the Sarikei Driving Institute. He pulled the victim's hair and threw a chair at her. As a result, the victim sustained injuries to the back of her ear, right elbow and right thigh.
