Posted on December 5, 2013, Thursday KOTA KINABALU: The High Court here affirmed the conviction and sentence of a police sergeant cum an assistant investigating officer against three convictions for bribery. Justice Ravinthran Paramaguru who dismissed an appeal by Hashim Mahzin, 56, held that there was no reason to interfere with the lower court's decision. In upholding the decision, Paramaguru ruled that the sentence was adequate taking into account that the appellant is a policeman, who had abused his position. However, Paramaguru granted Hashim a stay of execution pending his appeal to the Court of Appeal and maintained his earlier bail, pending disposal of the case. On Jan 9 this year, the Corruption Court here sentenced the appellant to a total of 30 months' jail and RM30,000 fine, in default, nine months' imprisonment for three corruption charges committed four years ago. He was found guilty of the charges framed under Section Section 16 (a) (B) of the Malaysia Anti-Corruption Commission (MACC) Act 2009 and punishable under Section 24 of the same Act, carries a maximum jail of 20 years and a fine of no less than five times the amount of bribe or RM10,000, whichever is higher, upon conviction. On the first count, he was jailed for eight months and fined RM10,000, in default, three months' jail for corruptly receiving RM1,000 from a woman for the purpose of settling a molest case of the woman's relative. On the second charge, he received another 10 months' jail and RM10,000 fine, in default, three months' jail for accepting a bribe from the same woman for the same purpose and on the third count, he was sentenced to 12 months' imprisonment plus RM10,000 fine, in default, three months' jail for receiving a RM500 bribe from a man for the same purpose. The offences were committed at the Kota Belud police station and at a restaurant in Kota Belud between Oct 16, 2010 and Dec14, 2010. The lower court ordered the appellant to serve his jail sentences concurrently and the appellant had paid the fine. Deputy public prosecutor (DPP) Joyce Blasius stood in for DPP Mohd Asnawi Abu Hanipah for the respondent while the appellant was represented by counsel Zahir Shah. Drug mules remanded another seven days Posted: 04 Dec 2013 05:13 PM PST SIBU: Two foreigners, a man and a woman, suspected to be drug mules, were ordered by a Magistrates' Court here yesterday to be further remanded for seven days to facilitate police investigation. The 56-year-old man and 30-something woman are believed to have in their possession 7.4kg of syabu worth about RM1.48 when they were arrested at Sibu Airport on Nov 27. The seizure was also said to be the biggest seizure of such substance by the police in the state this year. According to earlier news reports, the duo was on the same flight from KLIA. Police seized from the man 3.1kg of drugs believed to be syabu with a street value of RM625,000. Seized from the woman were 4.2kg of drugs also believed to be syabu with a street value of RM850,000. The drugs were concealed in their luggage, handbags, slippers, and inside ribbons. The suspects are believed to have flown in from Chennai and New Delhi en route to Kuala Lumpur. The case is being investigated under Section 39B of the Dangerous Drug Act 1952 which carries the mandatory death sentence upon conviction. Posted on December 5, 2013, Thursday KOTA KINABALU: The Sessions Court here yesterday fixed Dec 16–17 this year for the rape trial of a young local man. Judge Ismail Brahim fixed the dates at the mention of Wan Shah Riatin's case here yesterday. In the first charge, the 22-year-old is accused of raping a 14-year-old girl at a house, at a village in Kota Belud on May 7, this year at 2pm. The offence, stipulated under Section 376 (2) (d) of the Penal Code, carries a maximum 20 years' imprisonment, and liable to whipping, upon conviction. The accused faces a second charge under the same Section and same Act for raping the same victim, on May 6, this year at 9pm at the same place. Meanwhile, Mohd Sukri Jerin, 24, faces a charge for committing a similar offence under the same Section and same Act. The unrepresented accused allegedly raped an underage girl on May 6, this year at 12am, at a house in Kota Belud. The court fixed Jan 13, 2014 for his case management. Ismail also fixed April 21 – 22, 2014 for the rape trial of Mohd Almye Syah Ardon at the Sessions Court in Kota Belud. Mohd Almye, 24, is charged with raping another 14-year-old girl, on June 8, this year, also at a house in Kota Belud, at 11am. Deputy public prosecutor Nartiah F Mirchelle Sambatan acted for the prosecution while counsel Haji Shukor Abdul Mumin acted for Wan Shah and Mohd Almye.
