Man in fatal acid attack ordered to enter defence

KOTA KINABALU: The Sessions Court here yesterday ordered an unemployed Filipino to enter his defence on two charges of splashing acid on a Filipina and her daughter, and a charge of causing the death of her male infant.

Judge Ummu Kalthom Abdul Samad made the decision on Webster George, 22, after she ruled that the prosecution had established a prima facie case against the unrepresented accused.

On the first and second charges, the accused, who is a passport holder, was alleged to have splashed acid on the 39-year-old woman and her daughter aged 12, respectively, at a house in Kampung Gaur, Kota Belud at 5am on November 7, 2012.

The two offences, under Section 326 of the Penal Code, is punishable by a maximum jail of 20 years and also liable to a fine, upon conviction.

The third charge accused Webster of committing culpable homicide not amounting to murder of the six month-old baby boy at the same time and place.

Webster, who is the victims' neighbour, was charged under Section 304 (a) of the Penal Code which carries a maximum jail of 30 years and also liable to a fine, upon conviction.

The court fixed July 1 – 2 for the accused to enter his defence and he would produce seven witnesses to testify for his defence.

Deputy public prosecutor Afzan Abdul Kahar (DPP) has called 27 witnesses to give evidence against the accused.

In a separate case, a local mechanic pleaded not guilty in the same court to a charge of possessing 38.28 grams of syabu.

Vun Kon Fui, 34, was accused of having the drug at a workshop at Jalan Kolombong in Inanam at 3pm on November 6.

He was charged under Section 39A (2) (r) of the Dangerous Drugs Act 1952 which provides for life imprisonment or a jail term of not less than five years and whipping of not less than 10 strokes, upon conviction.

The judge set July 10 to re-mention the case and the accused was ordered to be held in custody pending disposal of the case.
