Man pleads not guilty to murder charge Posted: 10 Apr 2014 03:16 PM PDT SIBU: An Indonesian man charged with murder pleaded not guilty to the charge yesterday at the Sibu High Court. Daud Pasarrin is to appear in court again on May 19 for case management. He is charged under Section 302 of the Penal Code, which carries a mandatory death sentence upon conviction. According to the charge, Daud killed one Daud Duman at 2.30pm on July 20 last year at the workers' quarters of a timber camp in Belaga. Unemployed man remanded further Posted: 10 Apr 2014 03:14 PM PDT KUCHING: An unemployed man who claimed trial to voluntarily causing hurt while committing a robbery was ordered to be further remanded in jail by the Sessions Court yesterday. The 21-year-old accused, Mohd Afis Masot Saleh, appeared before Judge Marutin Pagan who made the order and set April 24 for further mention of the case. Trial was fixed for June 16. Afis allegedly committed the offence together with another person still at large somewhere at Jalan Batu Kawa about 2am on Feb 23. Voluntarily causing hurt in committing robbery, comes under Section 394 of the Penal code which provides the maximum 20 years' jail and whipping on conviction. The brief fact of case said that two men had stopped a car driven by a 54-year pensioner at Jalan Batu Kawa. They got into his car and shoved a knife at his abdomen, and punched him on the chest. The two men then fled the scene in their victim's car leaving the victim who was badly injured to fend for his own. On March 29, at 8.34am, a man and his girlfriend were taken into custody by the police in connection with a hit-and-run incident. Investigation showed that the car involved in the incident has the same specification with the car that was reported missing in Batu Kawa on Feb 23. |
Man fined, placed on 3-year supervision for taking drugs Posted: 10 Apr 2014 03:13 PM PDT KUCHING: A mechanic from Bau was fined RM5,000 in default six months' jail by a Magistrates' Court here yesterday after he pleaded guilty to consuming drugs. Magistrate Shafiza Abdul Razak Tready fined Frank Dominic, 32, whose urine was found positive when a test was conducted on him at Bau police station about 2.30pm on Jan 29. He tested positive of amphetamine and methamphetamine. Shafiza also ordered him to be placed on three years' supervision by the relevant authority. In mitigation, Frank, who was represented by Abdul Rahman Mohd Hazmi, told the court he felt remorse and promised he would not do it again. He said he did it due to peer pressure and had moved to Kota Samarahan to keep away from the negative influence. Frank was convicted under Section 15(1)(a) of the Dangerous Drugs Act 1952. He paid the fine. Inspector Ahmad Ilias prosecuted. Local fined for harbouring illegals Posted: 10 Apr 2014 02:52 PM PDT SANDAKAN: A local man was fined RM5,000, in default, five months' jail by the Sessions Court here for harbouring illegal immigrants. Mohd Ibrahim Bin Kadir, 53, pleaded guilty before judge Egusra Ali to a charge under Section 55E (1) of the Immigration Act 1959/63. The accused was arrested around 8.45pm on November 17, last year by Immigration enforcement officer during the 5P operation while driving a Perodua Kancil car at Lorong Sedco 3, Jalan Balai Bomba. There were three Pakistani men in the vehicle. Two of them, Alam Sher Amir Farosh Mardan and Taj Bahadar Sanobar Mardan, failed to show their valid travel documents. They were detained under Section 6 (1) (C) of the Immigration Act for illegal entry. The court also ordered the vehicle used by the accused to be seized. Man denies peeping at woman taking shower Posted: 10 Apr 2014 02:46 PM PDT KOTA KINABALU: A local man was charged at the Magistrate's Court here yesterday with outraging the modesty of a woman by peeping at her while she was bathing. Derry Mintai, 31, pleaded not guilty to the charge before magistrate Ryan Sagirann Rayner Jr, who set April 30 for his trial. He allegedly peeped at the 21-year-old woman while she was in the shower at Bandaran Berjaya on November 18, 2013. The charge under Section 509 of the Penal Code carries a prison term of up to five years, or with a fine. Assistant superintendent Sabrina Jinuis acted for the prosecution. In another Magistrate's Court here yesterday, a local man was fined RM1,000, in default, one month's jail for house trespass. Magistrate Zaiton Anuar imposed the fine on Yong Fook Hin, 47, after he pleaded guilty to illegally entering a unit at Angkasa Apartment, Jalan Tuaran Bypass, Menggatal, on April 4, this year. Meanwhile, a jobless man claimed trial to a similar offence before magistrate Ryan Sagirann Rayner Jr who then fixed April 24 this year for case management. Li Jia Xing, 26, denied trespassing into the home of an 80-year-old senior citizen along Jalan Kobusak, Penampang, on March 15, this year at around 3 am. The court released him on RM2,000 bail with two local sureties. Meanwhile, brothers Bonel Mijal, 22 and Belna Mijal, 20, denied possessing two stolen mountain bicycles belonging to Kelvin Chong @ Wilson, 53. They were alleged to have in their possession the stolen bicycles at the public toilet of the Likas Sports Complex tennis court on April 2, this year. The joint charge under Section 411 read with Section 34 of the Penal Code is punishable with a maximum of five years' jail or with fine or both, on conviction. Both accused were denied bail as they are without valid documents. Assistant superintendent Sabrina Jinuis acted for the prosecution. |
Fake MyKad lands Indonesian in jail Posted: 10 Apr 2014 02:44 PM PDT KOTA KINABALU: The Magistrate's Court here yesterday sent an Indonesian man to jail for five months for possession of a fake MyKad. Mohd Salleh Sanusi, 31, admitted before magistrate Zaiton Anuar to possessing an identification card belonging to Ahmad bin Lesebbi, bearing the serial numbers of 730401-12-1613, on April 6, this year at the car park premises of a resort here. The charge framed under Section 25 (1) (e) of the National Registration Regulations 1990 is punishable with a fine of between RM3,000 and RM20,000 or three years' jail or both, on conviction. The court also ordered the accused to be referred to the Immigration Department after serving his sentence. Meanwhile, the same court set April 30 for re-mention of a causing hurt case pending further instruction from the prosecutor's office. Yih Eng Chung, 43, is charged with hurting Lo Hon Bun, 34, by hitting him with a stick on July 13, 2013, at Kedai Kopi Shan Hai Tian, Taman Delima, Likas at around 7pm. However, Lo testified yesterday that he wished to retract his police report filed against the accused on account of their friendship. He said they had made amends and the accused had paid for the medical fees to treat his injuries, thus Lo did not wish to prolong the case anymore. The charge framed under Section 324 of the Penal Code is punishable with maximum imprisonment of three years, or with fine, or whipping, or with any two of such punishments upon conviction. Inspector Lim Swee Beng prosecuted in both the cases. |
