Posted on December 13, 2013, Friday KOTA KINABALU: The Sessions Court here yesterday sentenced four local men to eight years' jail plus two strokes of the cane for a joint charge of armed gang robbery. Judge Ismail Brahim convicted Joedir Johari, 35, Mohd Jay Jay Rodjit, 30, Noor Azmil Kaling, 35, and Ghazali Wong Abdullah, 46, after finding them guilty beyond a reasonable doubt. The four accused had on Nov 18, 2012, and an accomplice who is still at large robbed Theng Hock Sing, 28, of a laptop, sling bag, documents and money in a rented room in Membakut Jaya, Beaufort while threatening the victim with a 'samurai sword'. The charge stipulated under Section 395/397 of the Penal Code provides for up to 20 years' imprisonment and liable to whipping on conviction. The court, however, granted a stay of execution for all the accused, pending an appeal to the High Court. In mitigating for leniency, counsel Datuk Norbert Chin for all the four accused said they had not committed a serious offence prior to this although they were convicted for drug-taking offences. He also said that all the accused were remorseful over their action and they were married with families to support. In reply, deputy public prosecutor Nartiah F Mirchelle Sambatan pressed for an appropriate sentence considering the seriousness of the offence which involved a dangerous weapon. She further told the court that the victim faced trauma and fear because of the crime committed against him in addition to the loss of his valuables. The court also extended bail for all four accused, pending disposal of their case. The prosecution had called a total of ten witnesses during trial while the defence had called four. Sisters fined for threatening woman Posted: 12 Dec 2013 09:44 AM PST KOTA KINABALU: Two siblings were each fined RM25, in default, seven days in jail by the High Court here yesterday for separate charges of threatening a woman. Judicial Commissioner Azahahari Kamal Ramli fined Liew Pei Ha, 41, and Liew Pei Yen, 42, after allowing their appeals against their seven days' jail sentences. The two appellants pleaded guilty in the subordinate court to their charges under Section 8 (1) (e) of the Minor Offences Ordinance which carries a maximum fine of RM25 upon conviction. Pei Ha admitted to threatening the 34-year-old woman at Taman Satria here on August 7 this year while Pei Yen pleaded guilty to committing a similar offence to the same woman at the same time and place. Posted on December 13, 2013, Friday SANDAKAN: A 35-year-old man was sentenced by the Magistrate's Court here Tuesday to eight months' jail for causing hurt to his niece at their house in Kampung Sabak Baru, Karamunting near here. Prosecuting officer Inspector Majari Awal Jari told magistrate judge Mohd Zairi Zainal Abidin, the accused, Abdul Rashid Jahilon, was living in the same house with his elder sister and her family. He sneaked into his 14-year-old niece's room by climbing over the wall around 3am on December 6. The victim, Siti Paisa, woke up from her sleep when she realized that her uncle was on top of her and covering her mouth with his hands. She immediately shouted for help but was punched in her stomach and back by her uncle. Her parents, on hearing her screams, rushed to the room and found her crying in pain. They immediately apprehended the uncle and handed him over to the police station. Initial investigation revealed that Abdul Rashid bore a grudge against his niece for a long time and had sneaked into her room with the intention of causing hurt to her. Abdul Rashid pleaded guilty to the charge of voluntarily causing hurt under Section 323 of the Penal Code, which carries a punishment of up to one year's imprisonment and liable to fine, if found guilty. Posted on December 13, 2013, Friday TAWAU: A teenager was sentenced to seven years' jail and five strokes of the cane by the Sessions Court yesterday for gang armed robbery. Judge Amelati Parnell meted out the sentence on Hendra Junaid, 19, who pleaded guilty to a charge under Section 395/397 of the Penal Code. The accused robbed a 24-hour convenience store at Taman Bintang on November 23 about 4.40am with four persons, including two still at large. They went to a mini market in a Toyota Corolla with the intention to commit robbery. On arrival, the accused forced open the locked door before they entered and pointed a machete at the cashier. They then took a safe, a Samsung Galaxy Tab, a Sony Experia mobile phone and a Nokia mobile phone. They also took a gold ring, Celcom and Maxis reload cards and a bag containing money and identification card. The accused was detained on November 30 at about 2.45am at an unnumbered house at Kampung Kongsi 8, Jalan Kabota. Deputy public prosecutor Kamalia Yahdi prosecuted the case. Sessions Court adjourns graft case involving district officer to Dec 18 Posted: 12 Dec 2013 09:26 AM PST SIBU: The Sessions Court yesterday adjourned to Dec 18 the trial of a former district officer Wong See Meng charged with corruption. Wong was called to enter his defence when Judge Dean Wayne Daly said a prima case had been established last Oct 25. Yesterday, in his defence call, three witnesses were called to testify including Wong himself, Sibu Resident Sim Kok Kee and an accounts clerk. On Dec 18, another witness would be called to testify on the case. Meanwhile, Wong was brought to court to face a charge of corruption involving RM500 on April 10, 2013 and he pleaded not guilty to the charge. He was charged under Section 17(a) of the Malaysian Anti-Corruption Commission Act 2009, punishable under Section 24 of the same act. The section provides for 20 years' maximum jail sentence and a fine not less than five times the bribe or RM10,000, whichever is higher. Wong was said to have committed the offence at Sibu District Office in Wisma Sanyan at about 11.15am on Dec 31, 2011. The charge said he had corruptly obtained cash of RM500 from a lawyer, Stephen Lu, as a reward to approve a letter of administration for Lu's client, a Chinese national, Zhuo Jing.
