Living on prostitution earnings, ‘madam’ gets seven years jail

KOTA KINABALU: A 'madam' was sentenced to seven years jail by the Sessions Court for living on the earnings derived from prostitution.

Sessions Court judge Azhaniz Teh Azman Teh imposed the sentence on Lee Swee Lian after she admitted to committing the offence near a petrol station in Kampung Air on May 26, this year, at 9.35 pm.

The charge, framed under Section 372A of the Penal Code, carries a jail term of up to 15 years, and with whipping, and also liable to fine upon conviction.

Deputy public prosecutor Nartiah F Mirchelle Sambatan told the court that during a police observation, Lee and another woman were seen on the road across the petrol station in Kampung Air.

She said the two women were then seen offering their services to a man there. Subsequently, the three of them were seen moving towards Bandaran Berjaya area.

They were then seen entering a lodging house by a police raiding team along Jalan Masjid Lama around 9.50 pm.

Upon entering the premises, police found Lee sitting near the reception counter of the lodging house. She was later apprehended for running a prostitution service as a 'madam' (mama ayam).

The police also seized an Alcatel handphone and a Celcom simcard from her.

Nartiah urged the court to impose a heavy sentence on the accused taking into account public's interest and the rampancy as well as the seriousness of the offence.

She further said that the accused had profited from her role and said that the offence encouraged the act of prostitution.

The undefended accused pleaded for leniency and asked the court to begin her jail term from the date of her arrest.

Azhaniz granted her request and ordered her to serve her imprisonment from May 26.

Lee had initially made a plea of guilty when the charge was read to her but kept changing her plea.

In a separate case at the same court, a manager charged with attempting to rape a 26-year-old clerk had his case adjourned to September 24, this year.

Court judge Azhaniz told Ahmad Zulkifli Ab Wahab, 49, that his case will be heard before another judge who will also fix the trial date.

The judge explained that the case will be taken over by another court judge as he would be transferred soon.

Ahmad Zulkifli is accused of attempting to rape the victim at 11am on December 24, last year, at a complex in Lok Kawi.

The charge is framed under Section 376 of the Penal Code and punishable under Section 511 of the same Code, with imprisonment term of up to 10 years, and will also be liable to whipping.

Mohammad Nizar pleads not guilty to defaming Najib

IPOH: Former Perak Menteri Besar Datuk Seri Mohammad Nizar Jamaluddin was charged in the Sessions Court here yesterday with defaming Prime Minister Datuk Seri Najib Tun Razak two years ago.

Mohammad Nizar, 57, of Sungai Rokam here, however, pleaded not guilty and claimed trial to the charge.

He was charged with defaming the prime minister during a 'ceramah' at Taman Desa Pakatan here between 9pm and midnight on April 23, 2012.

Mohammad Nizar, who is Changkat Jering assemblyman, was alleged to have told the audience that he (Mohamad Nizar) was informed that Najib had called the army generals and told them to do something if Barisan Nasional lost in the general election.

The charge, under Section 500 of the Penal Code, carries a maximum imprisonment for two years or fine or both, if found guilty.

Deputy public prosecutor Masri Mohd Daud requested bail at RM5,000 in one
surety.

However, Mohammad Nizar's lawyer, Asmuni Awi, said there was no need for bail as it was a summon case and his client, who is also the state opposition leader, would cooperate with the prosecution.

Judge Madihah Harullah then set bail at RM4,000 with one surety and fixed Sept 26 for
mention.

Bank officer, husband given one month to appoint counsel

KUALA LUMPUR: A HSBC bank officer and her husband charged with transferring and withdrawing money, totalling RM85,180, from the accounts of four victims of the missing Malaysia Airlines flight MH370 have been given a month to appoint their counsel.

The grace period was given by Sessions Court Judge Norsharidah Awang following an application from the couple, Nur Shila Kanan, 33, and Basheer Ahmad Maula Sahul Hameed, 33, when the case came up for mention yesterday.

She then set Sept 25 for mention.

Earlier, deputy public prosecutor Ahmad Fadhli Mahmud informed the court that the prosecution had not handed over any documents to the accused or lawyers representing them.

Last Aug 20, Nur Shila and Basheer Ahmad Maula pleaded not guilty to the charges before Sessions Court Judge Mat Ghani Abdullah.

Nur Shila was charged with 12 counts of the alleged offences, while her husband, a mechanic, was charged with four.

The charges against Nur Shila were for allegedly transferring money, totalling RM40,000, from an account belonging to Malaysian citizen Hue Pui Heng, into the account of a Chinese citizen Tian Jun Wei, and another RM35,000 into an account belonging to one Ali Faran Khan.

The charges were made under Section 4(1)(a) of the Computer Crime Act 1997, which carries a maximum fine of RM150,000 or jail term of 10 years, or both, if convicted.

Nur Shila also faced three counts of using as genuine fake documents to apply for a new debit card on Tian's name and to make two applications for local fund transfer from two saving accounts belonging Chinese national Ju Kun and a flight attendant, Tan Size Hiang.

She was also charged with using a false Internet Banking Service Request Form and using the name of Judy Margaret Lai
to obtain a security device to activate the Internet banking service.

The charges, under Section 471 of the Penal Code, carries a maximum jail term of two years, or fine, or both, if convicted.

Nur Shila was also charged with two counts of cheating her supervisors, Nor Aini Derus@Mat Rose and Mohd Fazli Mokhtar, by making them believe that the applications for the new debit card were made by Tian and Judy personally.

The offence under Section 417 of the Penal Code carries a maximum jail term of five years, or fine, or both, upon conviction.

She was also charged with two counts of stealing RM2,530 from the accounts belonging to Ju Kun and Tan, an offence under Section 379 of the Penal Code which provides for a maximum imprisonment of seven years, or fine, or both, if convicted.

Nur Shila also pleaded not guilty to four alternative charges of stealing money belonging to the four victims.

The offences were allegedly committed at her workplace at HSBC Bank in Lebuh Ampang here between May 14 and July 8.

Meanwhile, Basheer Ahmad Maula was charged with four counts of using Tian's debit and ATM cards to withdraw a total of RM7,650 in four transactions.

The offence under Section 4(1)(a) of the Computer Crime Act 1997, provides a maximum fine of RM150,000 or jail term of 10 years, or both, if convicted.

He also faced four alternative charges under Section 379 of the Penal Code, for stealing money from the same account.

The offences were allegedly committed at HSBC Amanah automated teller machine in Ampang Point, Ampang here between 10.02am on May 15 and 11.28pm on June 29. — Bernama

Carjacker jailed for kidnapping, disposing of stolen 4WD

KOTA KINABALU: A 30-year-old man received a total jail term of seven and a half years and fined RM1,500 after pleading guilty to five charges of kidnapping, theft of a four-wheel-drive (4WD) vehicle and disposing of a Isuzu Dmax truck.

Muhamad Harianto was sentenced by magistrate Stephanie Sherron Abbie to two years in jail for each of the counts of kidnapping three children below the age of 14 at the Tamu ground in Menggatal town at around 10.20am on July 25.

The offence falls under Section 363 of the Penal Code which carries a term of imprisonment which may extend to seven years and a fine.

Stephanie allowed Muhamad to serve the jail sentences concurrently.

Prosecuting officer Chief Inspector Lim Swee Beng told the court the accused dropped all the three children at a bus stop near a church in the town area.

Muhamad pleaded for a lenient sentence as he merely stole the 4WD and did not see the children who were seated at the rear seat.

The facts of the case stated that the three children were brought by their mother to the Tamu ground in Menggatal town on that day.

The mother parked the vehicle at the parking lot with its engine still running with her three children inside it for shopping at the Tamu ground.

The accused then came and drove away the vehicle with the three children still inside.

Lim told the court that the three children were found at the bus stop unharmed the same, which led to the accused's arrest at the bus stop in Bandaran Berjaya here the next day.

Later, in another court, magistrate Cindy Mc Juce Balitus sentenced Muhamad to a year in prison, and a fine of RM1,500 in default four months in prison for stealing the 4WD.

The charge under Section 379A of the Penal Code is punishable with imprisonment for not less than one year and not exceeding seven years as well as a fine.

Cindy imposed a jail term of six months on Muhamad for concealing and disposing of an Isuzu Dmax truck.

He admitted to stealing the vehicle on June 16, around 9am at a Milimewa store in Tuaran town and sold the vehicle to a car dealer in Petagas on August 17 at about 1pm.

The offence falls under Section 414 of the Penal Code and carries a punishment of not less than six months and no longer than seven years as well as a fine.

The magistrate ordered Muhamad to serve the jail sentences consecutively.

Meanwhile, in a separate case, a 20-year-old man was sentenced to three months imprisonment for house tresspass by the Magistrate's Court here yesterday.

Jimar Imilan pleaded guilty before magistrate Cindy Mc Juce Balitus to the offence which he committed on June 10 at 10:30pm at a sundry shop in Kampung Kabayau.

The offence falls under Section 448 of the Penal Code which may extend to three years, a fine which may extend to RM5,000, or both.

He was also ordered to be referred to the Immigration Department once he had served his sentence.

Prosecuting officer Inspector Azaman Hamat prosecuted the case.

Man gets jail, caning for raping mother-in-law

SIBU: A father of eight who raped his 68-year-old mother-in-law was sentenced to 14 years' jail in addition to 10 strokes of rotan by the Sessions Court here yesterday.

Mohammad Abdullah @Su Ngiek Tiing pleaded guilty to the felony charge framed under Section 376(3) of the Penal Code.

According to the facts of the case, at about 4pm on Aug 15, while the victim was sitting on the mattress in the guest room of her house in Kampung Jeriah, Jalan Oya, she was approached by Mohammad.

After pushing her down, he then rolled out the victim's clothing before having sexual intercourse with her.

At that time, the victim tried to scream for help but her mouth was covered with a blanket.

Moments after raping the victim, the accused entered the bathroom before leaving the house.

The next day at about 7am, the victim related the incident to her daughter, Mohammad's wife.

Her daughter advised her to lodge a police report which was subsequently made the following day.

The victim was referred to Sibu Hospital for medical check-up on the same day.

Mohammad was later arrested in the early hours on Aug 17 at the same house and was remanded for a week.

Investigation revealed that he had indeed raped the victim.

In mitigation, Mohammad who was unrepresented, pleaded for leniency, saying this was his first offence and he is married with eight children.

In passing sentence, Judge Indra Ayub took into the account of the seriousness of the offence committed.

Guard jailed 10 years for raping, impregnating girl

KOTA KINABALU: The Sessions Court here yesterday sentenced a security guard to 10 years in jail for the statutory rape of a 15-year-old girl.

Azrin Bakri, 21, pleaded guilty before judge Azhaniz Teh Azman Teh to committing the offence on September 10 last year at 2.30pm inside the restroom of a car wash in Jalan Sepanggar, Menggatal.

The undefended Azrin was charged under Section 376 of the Penal Code which carries a jail term of up to 20 years and whipping upon conviction.

The facts of the case stated that the accused was a friend of the victim's brother.

Azrub and the victim's brother were drinking liquor before the accused took the victim to the restroom and raped her.

The accused pleaded for leniency, telling the court that he was a first-time offender and promised not to repeat the same mistake again.

He also promised to marry the victim who had given birth to a baby in June and genetically identified as his.

However, deputy public prosecutor Nartiah F. Mirchelle Sambatan urged the court to impose the maximum penalty due to the age of the victim, the severity of the crime and the fact that the victim had become pregnant as a result of the incident.

She also urged the court to take into account the frequency of such cases and the interest of the public.
